Commercial Use and IMG College Licensing Process
A. University of Delaware trademarks shall not be incorporated as a part of the name of an independent business enterprise in any manner to imply an official relationship between the University of Delaware and a third party.
B. University of Delaware trademarks shall not be used to endorse a private group or business unless authorized by the University, pursuant to a formal contract or sponsorship agreement with appropriate approvals.
C. All commercial use of University of Delaware trademarks must be approved by the Office of Communications and Marketing. Authorizations may be granted under the following conditions:
- A company is an officially licensed manufacturer of University of Delaware merchandise. View the current list of licensed vendors.
- A company is an “Official Sponsor/Proud Supporter” of the University of Delaware Athletics and/or the University of Delaware Alumni Association.
D. All companies and individuals wishing to extend congratulatory messages in commercial advertising or promotions must receive prior approval from the Office of Communications and Marketing. Such messages must be clearly separate from the sale or promotion of any products not specifically licensed by the University of Delaware.

Any use of all marks requires written approval prior to production. The name and marks of the University of Delaware are controlled under a licensing program administered through the IMG College.
IMG College Licensing Process
The licensing process can vary in length, based on the licensees’ responsiveness in meeting IMG College and the University’s policies and requests throughout the process. Many licensees can complete the application process within two months, while others may take considerably longer depending on how quickly they meet the requirements. For more information, please contact the IMG College Licensing. Generally the process is divided into three steps:
- Complete and submit a IMG College Licensing application.
- Submit designs and/or samples incorporating the marks of the University of Delaware; obtain product liability insurance; purchase IMG College holograms per the labeling requirements; complete product specification sheets; and complete Authorized Manufacturer’s Agreement (if applicable).
- Execute the IMG College Standard Retail Product License Agreement and the IMG College Special Agreement regarding Labor Codes of Conduct; provide factory site disclosure and pay all advance and administrative fees.
After receiving approval, a finished sample of the product must be submitted for review. Once final approval is granted, IMG College will send a License Agreement for execution. Once the Agreement is signed and returned to IMG College, an officer of IMG College will sign the Agreement and fully executed copies are returned to the licensee with royalty reporting forms. Until the licensee receives fully executed copies of the Agreement, it remains unauthorized to produce and/or distribute any merchandise incorporating the trademarks of the institution.
Licensing Agreement Options
There are three options in pursuing a license with the University of Delaware and The IMG College Licensing.
The Standard License is intended for companies that are capable of extensive production and retail distribution of their product(s) and/or are introducing a unique and commercially viable product to the collegiate market.
The Local License is for companies that desire to obtain a license with the University and are located in the University of Delaware’s immediate in-state marketplace.
Internal Campus Supplier License
The Internal Campus Supplier License is for companies that wish to produce items purchased by the University of Delaware for internal use only. An Internal Campus Supplier Licensee is not permitted to sell product(s) to retailers, direct to consumers, to nonexempt school departments or to any entity unrelated to the institution.
